BEVERLY HILLS, CA – March 25, 2026 – A new legal initiative is taking aim at social media giant Snapchat, as survivor advocates and a leading law firm launch a coordinated effort to pursue claims on behalf of families whose children were allegedly groomed, extorted, and exploited on the platform. The move comes amid a staggering nationwide surge in online child abuse, placing the design and safety features of popular apps under intense scrutiny.
The partnership between the advocacy group Helping Survivors and class action law firm Milberg seeks to provide a legal pathway for families, alleging that Snapchat’s core design may have contributed to a pattern of abuse against minors. This effort joins a growing chorus of legal challenges from parents and state officials who argue the platform has failed to adequately protect its youngest users from a rising tide of digital predators.
An Epidemic of Online Harm
The backdrop for this legal action is a crisis that child safety experts describe as an epidemic. Recent data from the National Center for Missing & Exploited Children (NCMEC) reveals a dramatic escalation in online enticement reports, which have ballooned from just under 300,000 to more than half a million in a matter of months. Even more alarming is the explosion in “sextortion” cases—a form of blackmail where perpetrators coerce victims into providing explicit images and then demand money under threat of publicizing the content. The FBI has reported a staggering 7,200% increase in such cases involving children, signaling a rapidly evolving and devastating threat.
Advocates warn that these are not isolated incidents but part of a calculated playbook used by predators who exploit the trust of young people. With an estimated 500,000 online predators active daily, children as young as eight have reported being targeted.
"What we are seeing is not random," said Kathryn Kosmides, a Survivor Advocate with Helping Survivors. "Children and teens are often manipulated by individuals posing as other teens, with young boys being targeted at alarmingly high rates. There is often a pattern—initial contact, building trust, then manipulation and coercion. By the time a child or parent realizes something is wrong, the situation has often already escalated."
Designing for Danger?
Central to the lawsuits against Snap Inc., Snapchat's parent company, is the argument that the platform is not merely a neutral conduit for communication but is defectively designed in ways that facilitate harm. Critics and legal filings point to several key features that allegedly create a dangerous environment for minors.
The platform's signature “disappearing messages” feature has long been a source of concern. While marketed as a tool for ephemeral, low-pressure communication, safety advocates argue it emboldens predators by making it difficult for parents or law enforcement to find evidence of grooming or extortion. This ephemerality can create a false sense of security for teens, encouraging them to share content they otherwise wouldn't.
Other features under fire include:
* Snap Map: A real-time location-sharing tool that can reveal a user’s precise whereabouts, creating potential for real-world danger if privacy settings are not meticulously managed.
* Quick Add: A feature that suggests new friends to users, which can connect minors with complete strangers, bypassing the safeguard of a “close friends” network.
* Lack of Robust Age Verification: Despite a stated age requirement of 13, critics argue it is trivially easy for younger children to create accounts, exposing them to risks and content for which they are unprepared.
Lawsuits filed by state officials have intensified this scrutiny. In September 2024, New Mexico’s Attorney General sued Snap Inc., calling the platform a “breeding ground” for predators and citing internal documents suggesting the company was aware of the scale of the problem. Lawsuits from Texas and Kansas have followed, alleging the company deceives parents about the app’s safety while employing addictive design features.
A New Legal Battleground for Big Tech
The initiative by Helping Survivors and Milberg is part of a broader legal shift to hold technology companies accountable for the real-world consequences of their products. Dozens of lawsuits are pending against Snap Inc. and other social media giants like Meta and TikTok, moving beyond claims of improper content moderation to argue that the platforms are inherently defective products.
This legal strategy attempts to sidestep the broad immunity typically granted to online platforms for user-generated content under Section 230 of the Communications Decency Act. By focusing on the design of the app itself as the source of harm, plaintiffs argue that the companies are liable as manufacturers of a dangerous product.
The new partnership aims to empower families who often feel helpless, particularly when the identity of the online perpetrator is unknown. Civil claims offer a different route to justice by focusing on the platform's potential negligence.
"In many of these cases, people are left without clear answers because the evidence disappears so quickly and the individuals responsible may not be identifiable," explained Marc Grossman, Senior Partner at Milberg. "Civil claims can provide a route forward by examining whether the platform itself failed to implement reasonable safeguards, and give families a clear path to accountability when those safeguards fall short."
In response to mounting pressure, Snap Inc. has introduced safety features like the “Family Center,” which gives parents limited oversight of their teens’ activity, and has publicly supported bipartisan legislation like the Kids Online Safety Act (KOSA). However, for many families and safety advocates, these measures are seen as too little, too late, and insufficient to counter the risks allegedly embedded in the platform's very architecture.
